What is a felony?
A felony is an extremely serious offense. Some examples of common felonies include homicide, rape, malicious wounding, grand larceny, forgery, and embezzlement. In Virginia, a felony is punishable by over a year in jail and/or a fine. Furthermore, in addition to a possible decades-long stint in jail, a felony conviction could result in the loss of an individual’s right to vote and to possess a firearm. Felony charges are normally resolved in the Circuit Court either through a guilty plea or a trial. A trial may either be with or without a jury.
What is a misdemeanor?
While not as serious as a felony, a misdemeanor is still a very serious offense. Some examples of common misdemeanors include assault and battery, reckless driving, DUI/DWI, destruction of property, petit larceny, trespassing, possession of marijuana and being drunk in public. In Virginia, a misdemeanor is punishable by up to 12 months in jail and up to a $2,500 fine. Misdemeanor charges are resolved in the General District Court either through a guilty plea or a trial without a jury.
